Malami Still Detained by EFCC Despite Court-Granted Bail Order | Nigeria News Today

The Bureau News reports that the former Attorney-General of the Federation, Abubakar Chika Malami, who was granted bail by an Abuja High Court through an order dated December 23, 2025, is still being held in the custody of the Economic and Financial Crimes Commission (EFCC) despite meeting his bail conditions.

In a statement released on Wednesday, Malami’s media aide, Bello Doka, described the continued detention as illegal, unconstitutional and a clear contempt of court. He condemned what he termed the EFCC’s use of media narratives to misrepresent facts surrounding Malami’s case, insisting that the former Attorney-General had voluntarily submitted himself for thorough investigation and duly complied with all stipulated bail requirements.

“His continued detention in EFCC custody constitutes a breach of legal procedure and a blatant abuse of office by the Commission, which is expected to respect and comply with valid court orders,” Doka stated.

According to him, detaining Malami for over fourteen days without arraignment places the EFCC in a position of an institution projecting itself above the law, contrary to democratic principles and Nigeria’s constitutional order. He noted that no law-abiding agency should hold a suspect indefinitely after bail has been granted by a competent court.

The Bureau News gathered that Doka further raised serious concern on the implications of disobeying court orders by a constitutionally established anti-graft body, warning that such action threatens democratic stability and erodes public trust in justice administration. He alleged that operatives of the EFCC even chased away a court bailiff who attempted to serve the bail order, insisting that this reflects outright defiance of judicial authority.

He challenged the Commission to immediately arraign Malami before a competent court if there is any credible case against him, rather than subjecting him to what he described as “media trial and deliberate misinformation.”
